1. About us

This website is operated by Suara Juta Sdn Bhd (Company No. 202301032193 (11256116-V)) trading as Travel FM Malaysia ("Travel FM", "we", "our", "us"), a company incorporated in Malaysia with its principal place of business in Kuala Lumpur. By accessing or using travel-fm.com, our mobile experiences, live audio stream, podcasts, newsletters, events and any other digital service we operate (collectively, the "Services"), you agree to be bound by these Terms of Use and by our Privacy Policy.

2. Acceptance of terms

These Terms form a legally binding agreement between you and Travel FM under the laws of Malaysia, including the Contracts Act 1950. If you do not agree with any part of these Terms, please do not use the Services. We may revise these Terms from time to time by posting an updated version on this page; continued use of the Services after changes take effect constitutes acceptance of the revised Terms.

3. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to register an account. Users under 18 may only use the Services under the supervision of a parent or legal guardian.

4. Your account

You are responsible for keeping your login credentials confidential and for all activities that occur under your account. Notify us immediately at hello@travel-fm.comif you suspect unauthorised use. We may suspend or terminate accounts that breach these Terms or that appear to be used for unlawful purposes.

5. Licence to use the Services

Subject to your compliance with these Terms, Travel FM grants you a limited, non-exclusive, non-transferable, revocable licence to access and stream our content for personal, non-commercial use. You may not redistribute, rebroadcast, sublicense, or exploit any content commercially without our prior written consent.

6. Intellectual property

All content on the Services — including audio streams, podcast episodes, articles, guides, artwork, trademarks, logos and software — is owned by or licensed to Travel FM and is protected under the Copyright Act 1987 and the Trademarks Act 2019 of Malaysia, as well as applicable international laws. Unauthorised copying, modification, or distribution is prohibited.

7. User submissions and conduct

If you submit comments, feedback, testimonials, or other materials to us, you grant Travel FM a perpetual, worldwide, royalty-free licence to use, reproduce, adapt, publish and distribute such submissions across our Services. You warrant that your submissions do not infringe any third-party rights and are not unlawful, defamatory, obscene, or otherwise objectionable under Malaysian law, including the Communications and Multimedia Act 1998.

You agree not to:

• use the Services to transmit any content that is unlawful, harassing, or infringing;
• attempt to gain unauthorised access to our systems or interfere with our infrastructure;
• use automated tools, scrapers or bots without our written permission;
• reverse engineer, decompile or otherwise attempt to extract our source code.

8. Third-party content and links

The Services may include content, advertisements, or links provided by third parties. Travel FM does not endorse and is not responsible for the accuracy, legality or reliability of third-party content. Your interactions with any third party are solely between you and that third party.

9. Advertising and sponsorship

Travel FM works with airlines, hotels, tourism boards and travel agencies. Sponsored segments and branded content are identified in accordance with the Malaysian Code of Advertising Practice and Malaysian Communications and Multimedia Content Code.

10. Disclaimers

The Services are provided on an "as is" and "as available" basis. To the maximum extent permitted by Malaysian law, Travel FM disclaims all warranties, express or implied, including fitness for a particular purpose, non-infringement and uninterrupted availability of the live stream.

11. Limitation of liability

To the extent permitted by law, Travel FM, its directors, employees and licensors shall not be liable for any indirect, incidental, consequential, or exemplary damages arising out of or in connection with your use of the Services. Our total aggregate liability shall not exceed RM 500 or the amount you paid us in the 12 months preceding the claim, whichever is greater.

12. Indemnity

You agree to indemnify and hold harmless Travel FM against any claims, liabilities, damages and expenses (including reasonable legal fees) arising from your breach of these Terms or your misuse of the Services.

13. Suspension and termination

We may suspend or terminate your access to the Services at any time, with or without notice, if we believe you have violated these Terms or applicable law. Provisions that by their nature should survive termination (including intellectual property, disclaimers, and limitation of liability) will do so.

14. Governing law and jurisdiction

These Terms are governed by and construed in accordance with the laws of Malaysia. The courts of Malaysia in Kuala Lumpur shall have exclusive jurisdiction over any dispute arising from or in connection with these Terms, without prejudice to any right to seek recourse under the Consumer Protection Act 1999 where applicable.
